HOURS OF SERVICE (DRIVER)

               DRIVER TERMS OF SERVICE

 

These Driver Terms of Service are a legally binding agreement between you (the “Driver”) and Omnitracs, LLC. 

 

Omnitracs provides Hours of Service (“HOS”) access to its customers  (the “customer’s”) pursuant to separately executed contracts.    By using or accessing the Hours of Service (Driver) application you agree to the following:

 

1.         Access and Use.

 

(a)    You are authorized by a Omnitracs customer to access Hours of Service (Driver).

 

(b)    You have not falsified your identity and will not provide false personal information or create or access an account for anyone other than yourself.

 

(c)    You will not share passwords and/or ID numbers.

 

(d)    You have read these Driver Terms of Service and understand them.

 

(e)    You will comply with all applicable laws when using or accessing the Internet and Hours of Service (Driver).

 

2.         Improper Purposes.  Driver shall not use Hours of Service (Driver) for “Improper Purposes,” which includes but is not limited to:

 

(a)    Use of Hours of Service (Driver):  (i) to harass, threaten or harm any person; (ii) for any unlawful purposes; (iii) to disrupt or interfere with another person’s use of Hours of Service (Driver) or any other system; or (iv) to access another Driver’s login or account information belonging to someone else.

 

(b)    Use of Hours of Service (Driver) to transmit content which: (i) is unlawful, harmful or otherwise objectionable as determined by Omnitracs; (ii) interferes with any proprietary rights of another person or company; or (iii) contains viruses or other code that might disrupt the functionality of HOS or any other system.

 

3.         Disclaimer.  You acknowledge and accept that there are risks associated with the use of the Internet and you assume any and all responsibility and liability related to (i) security, loss, storage, privacy, and confidentiality of information transmitted via the Internet; (ii) review of the privacy policies of any site visited by you via the Internet; and (iii) protecting any username and password provided to you for use of the Internet.  Omnitracs has no control of and assumes no liability or responsibility for information, data, content, services, products (including software), transactions, or communications that you access, download, purchase or engage in, through use of the Internet.
